Real Estate - School District and Public Entity Experience

The firm has a wide range of experience in the areas of real estate and land use and has represented school districts and other public entities on many such issues. The Real Estate Section handles transactional work such as the buying and selling of improved and unimproved land, commercial and industrial leasing, and real property secured lending, both for lenders and borrowers. The firm has experience in these areas specifically related to the District’s needs. For instance, the firm has represented schools, governmental entities and others on the following matters:

  • We are currently representing a district regarding an easement with the City of Phoenix for a pedestrian bridge.
  • We represented a district on several real estate matters, including most recently a CC&R issue with an industrial development center.
  • We represented a district in connection with all aspects of the sale of property previously purchased by the School Facilities Board that ultimately was unusable for the proposed school site; and represented the district in all aspects of the purchase of another appropriate school site.
  • We represented a district in several potential condemnation and real estate land purchase contracts.
  • We represented a district involving a Facilities Use Agreement and a real estate lease arrangement.
  • We assisted a district in revising and finalizing an option and easement agreement.
  • We represented a university in connection with its attempt to sell the Mesa experimental farm.
  • We represented the City of Marana including matters involving the Acacia Hills Specific Plan and the Pima Farms Specific Plan.
  • We successfully represented clients in a case that went before the Arizona Supreme Court striking down a proposed initiative that would have imposed a buffer zone around the periphery of the Tucson metropolitan area thereby making rezoning extremely difficult.
  • We represented Foundation for Blind Children in acquisition of real property on which they will be building their home facility, preschool, administrative offices, and facility for itinerate teachers for elementary and secondary grades.
  • We represented a major Arizona municipality in connection with the settlement of a large lawsuit involving inverse condemnation and related issues.
  • We have extensive experience in negotiation of development agreements with municipalities and other public entities.
