Represented various grading, framing, window and sliding glass door subcontractors in construction defect lawsuits in Arizona.
Represented one of the largest manufacturers of propane tanks in product liability litigation.
Represented several national hotel chains in premises liability litigation, including issues involving security, maintenance and staffing.
Defended premises liability case in which plaintiff suffered neurological injuries when knocked to the floor by a store employee. Received defense verdict at trial.
Represented Arizona’s largest public utility in wrongful death and catastrophic injury claims arising out of power line, maintenance and construction obligations.
Representation of an insurance provider in major disability actions in both state and federal court.
Represented a disability carrier in breach of contract, bad faith and punitive damages case where we prevailed on summary judgment on the bad faith and punitive damages claims.
Represented a life insurance company where plaintiff sued under a business overhead insurance policy claiming that he was entitled to a $750,000 benefit because he could no longer perform the duties of his occupation. The case involved hotly disputed issues over the insurance agreement and the plaintiff’s medical condition. Following cross-motions for summary judgment the court granted our client summary judgment. Plaintiff agreed to pay client a substantial portion of its attorneys’ fees.
Represented an insurance company where plaintiff sued for breach of contract, bad faith and punitive damages under a disability insurance policy. The plaintiff’s attorney had high expectations for this case and took a hard line in a private mediation. When the case did not settle, Lewis and Roca moved for summary judgment on the bad faith and punitive damage claims. The court granted summary judgment.
Represented a life insurance company in breach of contract, bad faith and punitive damages case. The plaintiff, an internist, claimed he could not perform the duties of an internist, because of a long-standing eye condition. The plaintiff’s attorney rejected attempts at settlement, demanding $2,000,000. Forced to litigate the case on the merits, Lewis and Roca filed a motion for summary judgment on all claims, which the court granted. The plaintiff appealed to the Court of Appeals. The Court of Appeals affirmed in a reported decision. The trial court also granted the client attorneys’ fees.
