Non-Competition Agreement

Representation of a transparent language service company who sought to enforce its non-competition agreement against its former employee after they went to work for a direct competitor. After our client filed for a temporary restraining order, the parties through counsel negotiated a preliminary settlement that negated the need for an initial hearing on the matter. Through counsel, the parties were able to negotiate a final settlement of the matter, which resulted in the former employee being prohibited from contacting any of the companies on the "Customer Companies List" agreed upon by the parties until 2010. The parties further agreed that the Court shall retain jurisdiction over the matter until 2010, in the event that a dispute arises with respect to the parties' performance under the stipulated order and settlement agreement.
