Intellectual Property - Domain Name Experience
Lewis and Roca has prosecuted dozens of domain name disputes, both before federal courts and the arbitration panels. On behalf of the United States Postal Service, we secured one of the first judgments under the Anti-Cybersquatting Protection Act. United States Postal Service v. Zipee, Inc., 140 F. Supp. 2d 1084 (D. Or. 2000). Other representative actions in this area include:

  • On behalf of community college district, obtained transfer of domain names confusingly similar to college names that hosted content advertising competitive educational services in one instance and graphic anti-abortion materials in another.
  • Represented Echelon Resorts Corporation in several cybersquatting cases to protect the trademarks for Boyd Gaming Corporation’s premier $4 billion Las Vegas mixed-use resort project that will replace its legendary Stardust resort. (District of Nevada)
  • Defended a cybersquatting arbitration on behalf of a French citizen and obtained one of the first findings that the complainant, a German company, engaged in Reverse Domain Name Hijacking.
  • Obtained a permanent injunction and order requiring domain names transfer in a cybersquatting lawsuit in federal court in Illinois on behalf of an international airline.
  • Represented the United States Postal Service in obtaining a transfer, through arbitration, of prioritymail.com.

We have also resolved hundreds of domain name disputes without the need for litigation.
