Intellectual Property - Copyright Litigation Experience
Our group boasts talented litigators with extensive experience litigating copyright issues, including before the Ninth Circuit and in jury trials. The subject matter of these cases range from computer software to personality/aptitude tests to clothing fabric patterns. Examples of copyright cases handled by Lewis and Roca are set forth below:

  • Defended community college in copyright infringement case pertaining to distance learning software and dispute over the scope of a perpetual license.
  • Defended community college in copyright infringement case arising from alleged posting of copyrighted materials on professor’s website.
  • Won summary judgement that safety warning language in connection with motorized scooters was not sufficiently original to warranty copyright protection.
  • Won unanimous jury verdict in favor of client credit card processing company in a copyright infringement trial focused on the issue of ownership of credit card processing software. The central issue at trial was the development and derivation of competing suites of software.
  • Represented a Taiwanese semiconductor fabricator in a challenge to the validity of a copyright registration covering computer microcode for semiconductor chips. The case involved two trips to the Ninth Circuit and an administrative challenge in the Copyright Office.
