- Represent a national bank in three mass actions brought by 700 German and Austrian citizens claiming securities fraud. Motion to dismiss granted in federal court; summary judgment granted in state court.
- Represent a national bank in multi-million action brought by numerous union pension funds that claim the Bank conspired with former Arizona Governor Fife Symington to defraud them.
- Represent a theatre group in action seeking $45 million on behalf of 90,000 putative class members for alleged violation of Telephone Consumer Protection Act.
- Represent a national insurance group in class action relating to use of third-party software to review insured’s medical bills for reasonableness. Persuaded trial court to decertify class.
- Represent the a State in putative class action brought on behalf of tens of thousands of state employees for allegedly improper change to retirement system. Dispositive motion pending.
- Represent several major insurers in mass action brought by dozens of major corporations alleging overcharging in the Arizona workers compensation market.
- Represented a law firm against claims that the law firm’s alleged malpractice caused damages of more than $75 million. Prevailed on motion for summary judgment and settled case on appeal for approximately $40,000.
- Selected by Trustee of restaurant chain trust to investigate and litigate claims on the bankruptcy estate against numerous vendors, professional service firms and underwriters.
- Represented a national airline in multi-million dollar action against software developer for claims arising out of defective software system.
- Defended a telecommunications company in suit claiming theft of trade secrets allegedly valued at $500,000,000. Case settled with payment to our client of $125,000.
- Defended an international engineering firm in an engineering malpractice suit brought by the City of Tucson in connection with a water treatment plant. The firm had designed the plant and administered the $100 million construction contract. The City sued, seeking $20 million in damages for alleged water leakage and concrete defects. The matter was mediated and successfully settled. We reported to Zurich, the E&O carrier for the client.
- Defended a communication and electronics company in a contract case brought by a controls contractor who contracted with the client’s agent to construct a semiconductor FAB plant in Tianjin, China. The plaintiff sought damages in excess of $23 million. Our client asserted a counterclaim for $8 million due to the plaintiff’s breach of the contract. The case was pending in Federal Court in the Northern District of California and recently settled.
