Collective Bargaining Agreement Breach

The Hotel Employees and Restaurant Employees International Union Welfare Fund and the Southern Nevada Culinary and Bartenders Pension Trust (the "Union") alleged that a restaurant client breached the collective bargaining agreement by failing to make contributions to the welfare fund and pension trust, and breached its fiduciary duties to the fund and the trust under ERISA. The unpaid amounts including principle, interest and liquidated damages exceeded $60,000.00, and continued to mount. Immediate negotiations between counsel resulted in a settlement without the restaurant client having to answer or otherwise defend the action.
