General Class Action Experience

  • Routinely represent insurers in class actions involving a wide range of issues. Such cases in recent years have encompassed claims for alleged overcharging for non-OEM parts, improper sales practices and disclosures, bad faith interpretation of homeowners’ policies relating to mold coverage, calculation of payments on certain policies, and use of third-party software to review insureds’ medical bills.
  • Represented a national insurance company in a multi-year, multi-plaintiff sales practices litigation in which plaintiffs alleged fraud in connection with life insurance policies (also known as the “vanishing premium cases”).
  • Represented several publicly traded companies in shareholder class action suits alleging losses of tens of millions of dollars.
  • Defended a large national insurer in a putative class action relating to the sale of charitable gift annuities.
  • Represented numerous large employers in class action cases, including claims involving wage and overtime issues or alleged discrimination based on age, gender, disability or race.
  • Defended putative class action involving claims of tens of thousands of former and current employees for allegedly improper changes made to our client’s pension plan.
  • Defended numerous class actions relating to the Telephone Consumer Protection Act seeking damages in the tens of millions of dollars.
  • Obtained dismissal of a putative class action suit alleging breach of fiduciary duty and fraud in connection with a publicly traded company’s ESOP, ESPP and 401k plans.
  • Successfully defended many mass actions, including mass actions alleging fraud by a prominent bank and a mass action alleging a nationwide conspiracy to overcharge in the workers compensation voluntary market.
  • Defended large financial institution in mass action involving over 100 claimants.
  • Defended workers compensation insurers in a mass action brought in state court by dozens of large corporations alleging overcharging of premiums.
  • Successful defense of many class actions, including a class action against medical insurers involving medical payment, a class action against a bank involving auto loans, and a class action against a telecommunications carrier involving the sale of charitable gift annuities.
  • Successful defense of many mass actions, including mass actions alleging fraud by a prominent bank and a mass action alleging a nationwide conspiracy to overcharge in the workers compensation voluntary market.
