Erik Foley handles all types of commercial litigation. He is particularly experienced in real property litigation involving, for example, mechanics liens and HOA disputes.

Erik also offers specialized experience in aviation litigation. A U.S. Air Force veteran, Erik began his military career as a maintainer of complex avionic systems, advancing to supervisor of maintenance for 14 F-15E aircraft. He continues his passion in the aviation industry as the holder of a private pilot certificate and is the proud owner of a vintage Mooney M20C.

Representative Matters

  • “First-chair” trial victory: Won a judgment for a plaintiff at trial regarding a partnership dispute.

  • Successfully represented a licensed contractor on multiple mechanics' lien related actions, obtaining a judgement and/or settlement in each completed matter. 

  • Ongoing representation of a local HOA for both litigation matters and HOA management. 

  • Represented a large bank for an appeal of an interpleader matter in the United States Court of Appeals for the Ninth Circuit; winning without oral argument after authoring the answering brief.

  • Won a $113,000 judgment, with punitive damages, for a pro bono client after a local automobile repair shop took advantage of his language barrier to fraudulently obtain loans in his name and perform unauthorized repairs on his vehicle.

  • Provided pro bono representation for a two-year old child in the Family Division of the Eighth Judicial District Court of Nevada. Prevailed at trial, allowing her to remain with her foster and future adoptive parents—the only family she had ever known.

  • "Parachuted in" to help a construction defect plaintiff after prior counsel lost a motion for summary judgment; won on a motion to reconsider, reinstating the client's claims.

  • Defended a Las Vegas helicopter tour company in a dispute regarding damages caused by an off-airport emergency landing. Successfully mediated the claim, avoiding litigation entirely.
