David Rosenfield is Of Counsel in Lewis Roca's Litigation Practice Group. David's practice has historically focused on commercial litigation and issues related to insurance coverage under several types of policies, including commercial general liability, mass property/casualty, directors' and officers' liability, errors and omissions, and kidnap and ransom, all resolved by way of litigation, mediation, and arbitration. David's representations have ranged from large publicly traded Fortune 500 corporations to small to mid-market private companies covering industries as diverse as commercial banking, mortgage lending, aviation, horse breeding, and health and fitness. In particular, for many years, David oversaw 50 contract lawyers and dozens of fellow associates in representing one of the largest commercial banks and mortgage lenders in the United States in pursuit of coverage against a dozen insurers for mortgage defaults in amounts exceeding one billion dollars.

David's commercial litigation experience also includes energy and construction litigation, mass tort, products liability, breach of contract, and securities fraud, and he is particularly skilled at contract drafting, interpretation and negotiation, managing large discovery budgets, and navigating large document review databases, particularly using Relativity. He has also authored several publications, both academic and practice-related.

At the firm, David's practice will focus primarily on the defense of first-party uninsured and underinsured motorists in Colorado on behalf of a large insurance client.

Representative Matters

  • Taken the deposition of approximately 100 plaintiffs in Ohio and elsewhere in the U.S. over the course of several years in $100 million lawsuit alleging exposure to a potentially harmful chemical while working in various factories throughout the U.S. over a 20-year period
  • Successfully defended $150 million breach of contract action on behalf of public utility company in Sacramento, California, resulting in a very favorable outcome for the client
  • Successfully defended trade secret misappropriation action under Ohio and federal law and countersued for unfair competition and tortious interference, handling all forms of discovery up and until successful settlement
  • Represented the largest mortgage lender in the United States in a variety of insurance coverage matters totaling approximately one billion dollars’ worth of insurance over a period of approximately six years
  • Represented corporate policyholders in the pursuit of insurance coverage in connection with the following types of commercial insurance policies: CGL, D&O, E&O, kidnap and ransom and professional liability
