Self Dealing in Multi-Million Dollar Trust Assets
Breach of fiduciary duty case against a financial institution for self dealing in multi-million dollar trust assets. Our clients were the remainder beneficiaries of the trust. The case involved complex factual and legal issues. A critical issue was whether the attorney client privilege protected communications between the financial institutions' trust officers and in house counsel. We were successful in piercing the privilege. The case was settled shortly after a jury trial commenced.
