  • The Hotel Employees and Restaurant Employees International Union Welfare Fund and the Southern Nevada Culinary and Bartenders Pension Trust (the "Union") alleged that a restaurant client breached the collective bargaining agreement by failing to make contributions to the welfare fund and pension trust, and breached its fiduciary duties to the fund and the trust under ERISA. The unpaid amounts including principle, interest and liquidated damages exceeded $60,000.00, and continued to mount. Immediate negotiations between counsel resulted in a settlement without the restaurant client having to answer or otherwise defend the action.
  • The Arizona Group recently obtained a judgment in Yuma County Superior Court dismissing a sexual harassment case with prejudice for failing to state a claim on the ground that the plaintiffs failed to follow the proper procedure steps to file a sexual harassment claim under Arizona's Civil Rights Act.
  • The Nevada Group represented one of the largest credit card processing companies in a Title VII race and sexual harassment/discrimination complaint (which upon investigation, was meritorious) pending in federal District Court of Nevada. The matter was resolved pre-answer through attorney negotiation and private settlement.
